This ordinance grants permission to Nathan Ross and Samuel Lynagn, the owners of 782-84 South 3rd Street, to install and maintain a dumpster enclosure. The enclosure will be located along the north sidewalk of Catharine Street, encroaching approximately 4 feet 6 inches towards the south from the property line. It will start about 63 feet west of the South 3rd Street curbline and extend 12 feet farther west, ensuring a minimum 6-foot clear unobstructed footway. The construction and maintenance must comply with City regulations, and the Department of Streets may allow minor variations in dimensions. Before exercising rights under this ordinance, owners must obtain all required permits and enter into an agreement with the City. This agreement stipulates conditions such as removing the encroachment upon 30 days' notice, assuming costs for utility adjustments, carrying public liability and property damage insurance (co-naming the City), insuring contractors, granting City access for inspection, indemnifying the City against losses, and furnishing a bond or self-assuming liabilities.
