An ordinance to grant permission to Howard Foreman, the owner of 1338-44 Rising Sun Avenue, Philadelphia, PA 19140, to install, own, and maintain a proposed fence encroachment. The fence will be located along the north sidewalk of West Westmoreland Street, encroaching approximately five feet towards the south along the north footway, starting 28 feet 4 inches east of the Rising Sun Avenue curbline and extending 71 feet farther east. A minimum of five feet of clear unobstructed footway will be maintained. The ordinance specifies that the construction, use, and maintenance of the encroachment must comply with city regulations, and the owner must obtain all required permits, licenses, and approvals. The owner is also required to enter into an agreement with the city, agreeing to remove the encroachment upon 30 days' notice, assume costs for utility changes, carry public liability and property damage insurance, and indemnify the city.
