The Louisville Metro Council approved an ordinance amending Section 1.1.9 of the Land Development Code (LDC) to extend the expiration date of approved development plans for affordable housing projects from two years to five years. This change applies to Detailed District Development Plans, Conditional Use Permit Plans, Category Review Development Plans, and Preliminary Subdivision Plans that include an affordable housing component. To qualify, developments must have at least 50% of units offered to residents at or below 80% Area Median Income (AMI) and/or at least 20% of units offered to residents at or below 30% AMI, with affordability maintained for 15 years. The amendment aims to provide a more reasonable timeframe for planning, construction, and implementation, acknowledging the complex financial and scheduling challenges often faced by affordable housing developments, which can lead to delays or project cancellations under the previous two-year limit. The Planning Committee reviewed the amendment on July 15, 2025 and July 24, 2025, and unanimously voted to send it to the full Planning Commission for a public hearing.
