A motion has been put forth by Councilwoman Katy Yaroslavsky to address challenges arising from the Resident Protection Ordinance (RPO) and Rent Stabilization Ordinance (RSO) concerning homeowners needing to modify their homes. Specifically, a CD 5 homeowner discovered black mold in their single-family residence and accessory dwelling unit (ADU), necessitating demolition. Both structures became subject to RSO after the garage ADU conversion. The motion directs the Los Angeles Housing Department, Department of City Planning, and Department of Building and Safety to authorize permits for the demolition of the existing single-family residence and ADU at 9019 Monte Mar Drive and to allow the rebuilding of a single-family residence with an attached junior ADU (JADU) in conformance with city codes. Additionally, it calls for these departments to report back within 30 days on recommended changes to RPO/RSO implementation to allow owner-occupied single-family homeowners to demolish their residences due to health conditions without triggering housing replacement requirements.
