Ordinance No. 127198, passed by the Seattle City Council on April 8, 2025, and approved by the Mayor on April 10, 2025, introduces interim provisions to activate street-level spaces in the Downtown, South Lake Union, and Uptown Urban Centers. This legislation amends several sections of the Seattle Municipal Code (e.g., 23.42.041, 23.48.005, 23.48.020, 23.48.040, 23.48.240, 23.48.740, 23.49.009, 23.49.011, 23.76.004, and 23.76.006) and Downtown Overlay Maps 1G and 1J. Key changes include enhanced flexibility in permitted street-level uses, allowing a broader range of activities such as offices, research and development laboratories, arts facilities, and food processing. It also reduces the minimum depth requirements for street-level uses from 15/30 feet to 8 feet and provides greater flexibility in floor area density limit exemptions, permitting second-floor and mezzanine spaces to be included without counting towards chargeable floor area. The ordinance aims to support economic recovery and fill vacant storefronts by expanding the pool of potential tenants and encouraging building renovations. To qualify, structures must have had a certificate of occupancy issued prior to the ordinance's effective date, and applications for interim use must be submitted within 36 months of its effective date. The legislation is temporary, set to expire 36 months after its effective date, but permitted uses under it can continue as non-conforming uses.
