An ordinance amending the Planning Code and Building Code to facilitate the repair and legalization of existing noncomplying and unpermitted accessory structures within required yards. It grants noncomplying status to unpermitted residential structures built before 2003 within yards, allowing them to be altered, repaired, or replaced in-kind without a Variance, provided dimensions remain consistent with pre-2003 conditions or are modified to comply with the Building Code. The ordinance also increases the allowed size of accessory structures in required yards from 100 SF and 8 feet tall to 120 SF and 10 feet tall, and exempts accessory structures up to 120 SF from building permits. It clarifies that these detached structures may not contain sleeping quarters, full bathrooms, or full kitchens, but may include wetbars and half bathrooms. The Building Inspection Commission unanimously recommended approval on July 16, 2025, and the Land Use and Transportation Committee acted on it on July 21, 2025, forwarding it to the Board of Supervisors for consideration on July 22, 2025. The Planning Commission adopted a recommendation for approval with modifications on June 26, 2025.
