This ordinance amends the Planning and Subdivision Codes to permit the separate conveyance of Accessory Dwelling Units (ADUs) and associated primary dwelling units as condominiums. Previously, ADUs could not be subdivided for separate sale or financing. The new legislation creates a process for property owners to convert ADUs into condominiums, requiring compliance with the Davis-Stirling Common Interest Development Act and the California Subdivision Map Act. It also mandates lienholder consent for conversion and a safety inspection of the ADU before condominium plan recordation. The Planning Department is required to submit a report by December 31, 2030, with recommendations for modifications to this ADU condominium conversion program.
