An ordinance signed by Mayor Daniel Lurie on May 9, 2025, authorizes settlement of the lawsuit filed by the San Francisco Apartment Association and the Small Property Owners of San Francisco Institute against the City and County of San Francisco for $135,000 in attorneys’ fees. The underlying litigation, filed in March 2022, challenged Ordinance No. 18-22, which amended Administrative Code Section 37.9 to require landlords to provide written notice and an opportunity to cure for certain evictions. Under Section 1 of the ordinance, $135,000 will be paid to petitioners’ counsel, thereby resolving the Petition for Writ of Mandate against the city. The lawsuit specifically addressed landlord-tenant eviction procedures, excluding cases of imminent health or safety issues or nonpayment of COVID-19 rental debt. Approval followed recommendations from the City Attorney’s Office, the Rent Board, and certification of available funds by the Controller. This action brings finality to litigation over eviction notice requirements.
