Ordinance amending Planning Code Sections 209.3 and 303.1 to remove the Conditional Use Authorization requirement for Formula Retail uses in the Residential-Commercial 4 (RC-4) zoning district fronting Van Ness Avenue, between Broadway and Redwood Street. The amendment principals permits Formula Retail uses on those lots without a Conditional Use hearing. It affirms the Planning Department’s California Environmental Quality Act determination and adopts public necessity, convenience, and welfare findings under Planning Code Section 302, together with findings of consistency with the General Plan and the eight priority policies of Planning Code Section 101.1.
