Ordinance amending Planning Code Sections 209.3 and 303.1 to remove the conditional use authorization requirement for formula retail uses in the RC-4 and RC-3 zoning districts along Van Ness Avenue between Broadway and Redwood Street, for lots fronting the Avenue. The ordinance also clarifies that a change of owner or operator of a pre-existing formula retail use that had not obtained a prior conditional use authorization does not constitute an intensification requiring a new authorization. It affirms the Planning Department’s CEQA exemption, makes public necessity, convenience, and welfare findings under Planning Code Section 302, and finds consistency with the General Plan and the eight priority policies under Section 101.1.
