The ordinance requires ADUs converted to condominiums to comply with the Davis-Stirling Common Interest Development Act and San Francisco Subdivision Code. It also mandates a safety inspection of the ADU prior to condominium plan recordation and requires lienholder consent for the conversion. The Planning Department is tasked with submitting a report by December 31, 2030, with recommendations for modifications to the ADU condominium conversion program. The Planning Commission recommended approval with modifications on February 13, 2025, to limit the program primarily to new, detached ADUs in single-family homes and new construction condominium projects, and to move state-mandated requirements to the Subdivision Code to avoid rent control complications and protect existing tenant-occupied units from conversion risks.
