The Philadelphia City Council enacted Bill No. 250291, amending Section 14-533 of The Philadelphia Code, which governs the Mixed Income Neighborhoods (/MIN) Overlay District. The amendment exempts certain residential developments from the /MIN District's requirements for providing 15% or 20% affordable dwelling units on-site. This exemption applies to programs designed to create affordable homeownership, which mandate deed restrictions and agreements establishing ongoing affordability requirements. Specifically, developments where 51% or more units meet the definition of "Affordable Housing Property" or where all units are part of a program for first-time homebuyers meeting HUD affordability standards (up to 100% AMI) are exempt. This ordinance took effect immediately upon passage.
