Philadelphia Extends Permit Reapplication Ban from One to Two Years Following Zoning Board Denial

This ordinance amends Title 14 of The Philadelphia Code, “Zoning and Planning,” specifically revising the “One Year Rule” to a “Two Year Rule.” The original rule limited the filing of substantially similar permit applications for the same property within one year after an appeal to the Zoning Board of Adjustment was denied or dismissed. The amendment extends this period to two years. This means that if the Department of Licenses and Inspections (L&I) determines an application is substantially similar to a previously denied or dismissed application within the past two years, and it's not an application L&I can grant as of right, L&I will deny the new application. Appeals to this “Two Year Rule” denial are limited to two issues: whether L&I properly applied the rule, or if materially changed circumstances warrant consideration.
