This ordinance amends Chapter 9-800 of The Philadelphia Code, titled 'Landlord and Tenant,' to regulate fees charged by landlords to prospective residential tenants. It restricts landlords, owners, real estate brokers, and agents from charging any fees other than for background and/or credit checks. The total charge for these checks cannot exceed the actual cost or fifty dollars, whichever is less. Landlords are prohibited from performing 'hard pull' credit checks that impact a prospective tenant's credit score. Additionally, a landlord or owner cannot charge a prospective tenant more than one fee in any 12-month period for applications at any of their properties. The ordinance also mandates that a copy of any background or credit check be provided to the individual, and all checks must comply with the Fair Credit Reporting Act.
