Philadelphia Council Urges State to Seal Eviction Records After Seven Years to Expand Housing Access

Philadelphia City Council adopted Resolution No. 250343 to call on the Commonwealth General Assembly to enact the Ready to Rent Act, which would automatically seal eviction records seven years after filing. The resolution highlights how public eviction records can unfairly penalize tenants long after case outcomes, limit housing opportunities, and exacerbate homelessness and legal representation disparities. It cites research from the University of Pennsylvania Carey Law School and Community Legal Services showing that default judgments disproportionately affect unrepresented tenants who rely on public transit and that eviction filings often impair renters' ability to secure housing or request repairs. The U.S. Consumer Financial Protection Bureau reports that one in five eviction records may contain false or ambiguous information, and twenty percent of filings never result in judgments yet remain on record. A study found that eight in ten tenants avoid requesting repairs for fear of retaliation. The resolution recalls Philadelphia’s prior Fair Criminal Record Screening Standards (2011) and Renters Access Act (2021) and notes that states such as Arizona, California, and New Jersey already enforce automatic sealing of broad categories of eviction records. It further references HB 1095 and SB 549 introduced in Harrisburg and notes Governor Shapiro’s support in his 2025 budget address.
