Special Committee Established to Reform Abandoned and Blighted Property Conservatorship Act (Act 135)

  • City: Philadelphia
  • State: PA
  • Category: Zoning Code Modification
  • Subcategory: Process updates

The City Council authorizes the creation of a Special Committee on Reform of Act 135, the Abandoned and Blighted Property Conservatorship Act, empowering it to analyze the law’s application and propose legislative or policy changes. The resolution tasks the Committee with conducting hearings, collaborating with community members, and delivering a full public report of findings and recommendations to the General Assembly, the Mayor, and the Council. Act 135, enacted in 2008, allows non-owners to petition courts to rehabilitate blighted properties without owner consent and recover costs, including legal and developer fees. Despite its redevelopment goals, the Act has been exploited by predatory developers and some non-profits, disproportionately affecting Black and Asian American homeowners and driving displacement in gentrifying neighborhoods. The Committee’s membership will include community representatives, City Council members, state legislators, and the Mayor’s administration. Upon conclusion, the Committee must submit detailed legislative recommendations to better align Act 135 with its original intent and safeguard vulnerable property owners. The full report will also be made available to the public to ensure transparency and accountability.
