Local Law Approved to Create New 311 Rooftop Activity Complaint Categories and Mandate Annual Reporting on Rooftop Recreational Spaces

The New York City Council approved a local law amending the administrative code to require the Department of Information Technology and Telecommunications (DoITT) to create a separate 311 complaint category for rooftop activities. This new category will include subcategories for complaints regarding rooftop occupancy without proper certificates or permits, and exceeding authorized rooftop occupancy. It will also add a subcategory under 'noise' for rooftop activity complaints. The law further mandates that the Department of Buildings annually report on the number of city rooftops with recreational spaces indicated on a Certificate of Occupancy or Place of Assembly Certificate of Operation, disaggregated by community board, starting by March 31st each year. The report must include the address of buildings with such spaces and those issued a place of assembly certificate of operation for rooftops. The public will be able to submit photographic or video evidence with these complaints. The law takes effect one year after its enactment.
