The City Council adopted a home rule message authorizing the City of New York to discontinue approximately 3,352,577 square feet (76.9646 acres) plus 15,737 square feet (0.361 acres) of parkland in Flushing Meadows Corona Park for alienation by lease or agreement with Queens Future, LLC. The discontinued land may be developed, constructed, maintained, operated, used or occupied for a gaming facility and, in conjunction therewith, commercial, retail, entertainment, recreational, hotel, convention, and community facility uses, as well as supporting parking and roadways. The authorization is contingent upon dedicating an amount equal to or greater than the fair market value of the land to acquire new parklands or fund capital improvements to existing park and recreational facilities within Queens, including the creation of no less than 20 acres of park space within or adjacent to the described tract. A north-south pedestrian connection from the passerelle bridge to Boat Basin Place must also be constructed and maintained by Queens Future or its affiliates. Federal funding requirements apply if any federal assistance was previously received for the discontinued parkland, including satisfaction of U.S. Department of the Interior substitution criteria. Construction of the gaming facility must commence within fifteen years or the land reverts to the NYC Department of Parks and Recreation for park use. The act does not preempt ULURP or racing, pari-mutuel wagering, and breeding law procedures.
