An ordinance to amend Title 17 of the Metropolitan Code of Laws by changing the zoning from AR2a to SP for a 12.15-acre property located at 2304 Hobson Pike. The rezoning permits the development of 59 multi-family residential units. Short Term Rental Property (STRP), both owner-occupied and not owner-occupied, are prohibited. The plan includes conditions such as separating uses in the development summary, dimensioning the half right-of-way, reducing parking to reflect 59 units, adding a Type C landscape buffer, and providing architectural elevations. The final site plan must label internal driveways as “Private Driveways” and note maintenance by the Property Owners' Association. Compliance with Metro Reviewing Agencies is required. A corrected preliminary SP plan must be submitted to the Planning Department prior to or with the final site plan application. No master permit/HPR will be recorded before final SP approval. A final plat may be required prior to permitting. If development standards are absent from the SP plan or Council approval, the property will be subject to RM6 zoning district standards, except for permitted uses. Metro Fire Marshal's Office requirements for emergency vehicle access and water supply must be met before building permits are issued. Minor modifications to the preliminary SP plan can be approved by the Planning Commission if consistent with the approved plan's principles and objectives, but increases in density or floor area, new uses, elimination of specific conditions, or new vehicular access points require a separate ordinance.
