An ordinance was approved by the Metropolitan Council authorizing Henrad Centennial Development I, LLC to maintain an existing underground and aboveground encroachment into the public right-of-way at 5701 Centennial Boulevard. The encroachment consists of a small portion of an existing building. The applicant is required to indemnify the Metropolitan Government of Nashville and Davidson County from all claims related to the construction and maintenance of the encroachments. Additionally, Henrad Centennial Development I, LLC must post a certificate of public liability insurance of at least $4,000,000 in aggregate with the Metropolitan Clerk, naming the Metropolitan Government as an insured party. The authority granted is a privilege and not a franchise, and the Metropolitan Government reserves the right to repeal the ordinance if public welfare demands it, requiring the developer to remove the encroachment at their own expense. The maintenance of the encroachment will be under the direction of the Director of the Nashville Department of Transportation and Multimodal Infrastructure (NDOT).
