The Metropolitan Government of Nashville and Davidson County approved a resolution authorizing 300 Broadway, LLC to construct, install, and maintain two double-faced LED illuminated blade projecting signs that will encroach into the public right-of-way at 300 Broadway. The resolution stipulates that 300 Broadway, LLC must indemnify the Metropolitan Government against all claims related to the construction and maintenance of the encroachment. Additionally, prior to receiving a permit, the applicant is required to file a certificate of public liability insurance of at least $2,000,000 naming the Metropolitan Government as an insured party with the Metropolitan Clerk and the Nashville Department of Transportation and Multimodal Infrastructure (NDOT). The construction and maintenance of the aerial encroachment will be under the direction, supervision, and control of the Director of NDOT and must be approved by the Director upon completion. The authority granted is a privilege, not a franchise, and can be repealed by the Metropolitan Government if public welfare demands it, requiring the LLC to remove the encroachment at its own expense. The resolution passed with the requirement of 21 affirmative votes.
