A resolution was approved to authorize Grand Ole Opry, LLC to construct, install, and maintain an LED illuminated blade sign encroaching into the public right-of-way at 116 Rep. John Lewis Way North. The Metropolitan Government of Nashville and Davidson County allows for such encroachments by resolution. Grand Ole Opry, LLC has agreed to indemnify and hold the Metropolitan Government harmless from any claims for damages arising from the installation of the aerial encroachment. The applicant is required to file a certificate of public liability insurance of at least $2,000,000, naming the Metropolitan Government as an insured party, with the Metropolitan Clerk and the Nashville Department of Transportation and Multimodal Infrastructure (NDOT) prior to receiving a permit. The construction and maintenance of the encroachment will be under the direction, supervision, and control of the Director of NDOT and must be approved by said Director upon completion. The resolution confers a privilege, not a franchise, and can be repealed if public welfare demands it, at which point Grand Ole Opry, LLC must remove the encroachment at their own expense. The authority granted will not interfere with the Metropolitan Government's rights to enter, construct, operate, maintain, repair, rebuild, enlarge, and patrol its utilities. The construction must be completed promptly to cause the least inconvenience to the public, and the authority becomes effective only after the insurance certificate is posted.
