This ordinance amends Chapter 17.37 of the Metropolitan Code, specifically modifying the Downtown Code (DTC) to update its bonus height program, outdoor space general standards, and add electric vehicle parking standards. The bonus height program, originally adopted in 2010, allows developers to increase building height by providing public benefits. The updated program replaces the previous nine options with three baseline requirements (green building certification, upper-level garage liner building, and active & sustainable transportation) and six bonus options (elevated green building certification, preservation, privately owned public spaces, neighborhood support space, reduction of vehicular parking, and underground parking). Eligibility for new developments over 50,000 SF requires meeting baseline requirements for a 2-story bonus. The ordinance also replaces existing open space standards with new outdoor space standards, covering both Metro-owned and privately-owned public spaces, with general regulations for site context, design, fixtures, furnishings, and materials, and type-specific requirements for various outdoor areas. Furthermore, new EV parking standards are introduced to regulate EV-capable and EVSE-installed parking spaces. The Planning Commission recommended approval (7-0) on March 13, 2025, and the Metropolitan Council passed it on third reading on May 20, 2025, with final action on the same date. The Mayor approved it on May 22, 2025, and it became effective on May 30, 2025.
