Nashville Gulch Hotel Secures Private Encroachment License from Metro

The Metropolitan Government of Nashville and Davidson County granted a revocable license to Nashville Gulch Lifestyle Hotel Owner, LLC allowing construction, maintenance, installation, and operation of a private encroachment into, onto, over, or under the public right-of-way at 118 12th Avenue South. The license requires execution of a bond or liability insurance policy with specified limits and 30 days’ notice to the Director of NDOT before cancellation. It waives subrogation rights against Metro and indemnifies the city for any claims arising from the encroachment’s construction, use, or maintenance. Licensee must complete the encroachment within 36 months of council approval or the license automatically terminates. In the event of substantial destruction, restoration within 36 months is required or the license will lapse. Licensee bears all costs of construction, maintenance, relocation, and eventual restoration of public property. Assignment of the license requires approval by both the Director of NDOT and the Metropolitan Attorney. Metro reserves the right to revoke the license by resolution, without compensation to licensee, if public welfare or convenience so requires. Upon revocation or termination, licensee must restore the right-of-way to its original condition at its sole expense. The license is strictly subject to existing public right-of-way easements and may not interfere with Metro’s rights and duties. Failure to maintain required insurance or bond creates a lien in the amount of the last effective policy. Any interference with Metro-owned easements is additional grounds for revocation.
