An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2A to SP zoning for property located at 4120 Murfreesboro Pike, at the current terminus of Smokey Mountain Place (11.22 acres), and within the Murfreesboro Pike Urban Design Overlay District, to permit 90 multi-family residential units. Short-term rental properties, owner occupied and short-term rental properties, not owner occupied shall be prohibited. Conditions include adding a note to the landscaping sheet that the final landscaping plan shall meet all standards of the Metro Zoning Code and the Murfreesboro Pike UDO, showing a Type B landscape buffer along side and rear property lines, requiring side elevations fronting private drive and public streets to have a minimum glazing of 15 percent, revising 'base zoning' to 'fallback zoning', and identifying short-term rentals as prohibited uses. Further conditions require architectural elevations with final site plan submittal, labeling internal driveways as 'Private Driveways' to be maintained by the Homeowner's Association, meeting Metro Fire Marshal's Office requirements, and complying with all conditions of Metro reviewing agencies.
