The Metro Council of Nashville and Davidson County has passed an ordinance amending Section 17.04.060 of the zoning code to add a definition for 'Bar or Nightclub' and update the definition for 'Beer and Cigarette Market'. The new definition categorizes bars and nightclubs based on occupancy, defining 'Small' as 100 people or fewer and 'Large' as greater than 100 people. Additionally, the definition for 'Beer and Cigarette Market' has been broadened to include establishments selling products containing nicotine, cannabidiol (CBD), tetrahydrocannabinol (THC), and similar substances, removing the requirement that businesses must advertise themselves as such. The Metropolitan Planning Commission recommended disapproval of the original bill but approved a substitute version, which was passed unanimously by the council.
This amendment clarifies zoning classifications for bars, nightclubs, and retail establishments selling alcohol and tobacco-related products, improving regulatory enforcement and land-use planning in Nashville.
