Ordinance No. 187,709, which previously prohibited new oil and gas extraction and made existing activities nonconforming in all zones, is being officially rescinded by the City of Los Angeles. This action is a direct consequence of a stipulated judgment and writ of mandate issued by the Los Angeles Superior Court in the case of Warren E&P, Inc. v. City of Los Angeles. The court's ruling determined that the original ordinance was preempted by state law, rendering it unenforceable. As a result of this rescission, all amended or deleted definitions, paragraphs, subdivisions, and subsections within Sections 12.03, 12.20, 12.23, 12.24, and 13.01 of Chapter 1 of the Los Angeles Municipal Code will revert to their original language and legal effect as they existed prior to the adoption of Ordinance No. 187,709. The City Council is currently recommended to adopt this draft ordinance to ensure compliance with the terms of the court's judgment. Importantly, the stipulated judgment preserves the City's inherent right to enact future oil regulations, provided they align with applicable laws.
