This ordinance rezone approximately 5.16 acres located at 901, 937, and 940 Main Street N. in Jacksonville, FL, within Council District 7. The properties, owned by Ocean Hart, LLC, Dozier Prestige Worldwide, LLC, and Ollivanders Downtown, LLC, were rezoned from Public Building and Facilities-1 (PBF-1) District and existing Planned Unit Development (PUD) districts to a new Planned Unit Development (PUD) District. The new PUD zoning permits a diverse range of uses, including schools, multifamily residential dwellings, and various commercial establishments. Notably, it specifically allows for the sale and service of all alcoholic beverages—liquor, beer, and wine—for both on-premises and off-premises consumption, even on property located less than 1,500 feet from a church, by granting a waiver of the minimum distance requirement. This relief is pursuant to Section 656.805 of the Ordinance Code, as detailed in the Main Street Mixed-Use PUD. The rezoning is subject to certain conditions, including compliance with Florida Department of Environmental Protection standards for soil and groundwater cleanup at 901 Main Street North, requiring the property to be remediated or subject to an approved Brownfields Site Rehabilitation Agreement/Remedial Action Plan. Additionally, a traffic study must be provided during Civil Site Plan Review, adhering to Land Development Procedures Manual Section 1.1.11.
