This ordinance amends Chapter 59 of the Denver Revised Municipal Code to incorporate standards for accessory dwelling units (ADUs) on properties retaining their former Chapter 59 zoning designations. It establishes one ADU per single-unit primary dwelling and aligns floor area, building footprint, height, setback, and ownership requirements with the Denver Zoning Code. The proposal adds ADU allowances and design standards for attached and detached accessory structures, including maximum floor area of 864 SF to 1,000 SF depending on lot size, and bulk plane and setback rules for RS and R zones. Detached ADUs are regulated for height (24 ft), footprint, location within rear 35% of lot, and side and rear setbacks varying by neighborhood context. Use by mobile homes or RVs is prohibited, and material requirements are relaxed. Ownership and occupancy rules vary by zone, requiring owner-occupancy in certain districts but not in others. The amendment also authorizes administrative adjustments to reconcile former Chapter 59 provisions with state and federal laws. The code change takes effect December 16, 2024.
