The applicant, Gender Road Limited Partnership, requests a rezoning from AR-12 (Apartment Residential District) to CPD (Commercial Planned Development District) for a 15.47-acre undeveloped site. The proposed use is a commercial shopping center with gasoline sales. The proposal includes customary use restrictions, setbacks for a convenience store with gasoline sales, parking and maneuvering setbacks, and building setbacks for the site's frontage. Extensive building materials commitments, maximum gross floor area for commercial uses, and buffering with a 6-foot fence and evergreen trees are also proposed. This is a refiled application after previous rezoning proposals for the site were defeated by City Council in 2000 and 2002. The City Departments' recommendation is disapproval, citing that the Brice/Tussing Area Plan recommends residential development for this site.
