This petition rezones approximately 7.59 acres on the north side of Shopton Road in Charlotte from N1-A ANDO (Neighborhood 1-A, Airport Noise Disclosure Overlay) to ML-2(CD) ANDO (Manufacturing & Logistics-2, Conditional) to legalize an existing contractor office with outdoor storage that was operating illegally. The rezoning limits allowable uses exclusively to contractor office with outdoor storage and caps building height at 40 feet. It establishes a 65-foot Class A landscape yard along the western boundary adjacent to CG and N1-A zoning and a 25-foot Class B landscape yard adjacent to I-2(CD) ANDO. The rear 2.59-acre portion remains N1-A(CD) ANDO to preserve a tree save area near residential homes on Gerald Drive. The plan follows four similar adjacent rezonings converting Neighborhood 1 properties to industrial uses and seeks to better align this parcel with surrounding industrial zoning and the Airport Noise Disclosure Overlay. Staff recommended approval despite the 2040 Policy Map’s Neighborhood 1 Place Type recommendation, citing resilience of economic opportunity and the unsuitability of residential development due to noise and adjacent industrial uses. CDOT has resolved any transportation issues and Charlotte Water will coordinate sanitary sewer extensions.
