The City of Charlotte approved Rezoning Petition 2024-110 to rezone ±51.78 acres east of Claude Freeman Drive, north of Davide Taylor Drive, and west of Senator Royall Drive from O-1(CD) (Office, Conditional) and RE-3(O) (Research, Optional) to CAC-1(EX) (Community Activity Center-1, Exception). This rezoning enables a two-phase residential community featuring up to 580 multi-family dwellings and a minimum of 7,500 square feet of commercial space. The petition requests three EX deviations from UDO standards: widening the build-to zone from 35 to 50 feet, reducing the build-to percentage from 60% to 30%, and permitting primary entrances to face side streets or parking instead of a street. Public benefits include dedicating two acres of open space to Mecklenburg County, constructing all buildings to NGBS bronze standards, and a $10,000 contribution to Mecklenburg County Parks & Recreation. Transportation enhancements comprise new turn lanes on David Taylor Drive, an ADA-compliant bus stop, 12-foot multi-use paths with planting strips on David Taylor Drive and Public Street A, and sidewalks with planting strips on Public Streets B and C. All drive-through uses are prohibited. CDOT approved the Comprehensive Transportation Review (CTR) with Tier 3 multimodal and TDM assessments on February 21, 2025. The site lies within the Community Activity Center place type on the 2040 Policy Map. Staff and Zoning Committee recommendations found the petition consistent with the 2040 Plan’s goals for 10-minute neighborhoods and neighborhood diversity. The rezoning is projected to generate 3,368 daily trips versus 4,366 under existing entitlements and add 75 students to local schools.
