This petition rezones approximately 51.78 acres east of Claude Freeman Drive and north of David Taylor Drive from O-1(CD) and RE-3(O) to Community Activity Center-1 (EX) to permit a two-phase mixed-use development of up to 580 multi-family dwellings and at least 7,500 square feet of commercial space. Phase 1 allows up to 320 stacked units and 3,000 SF commercial, while Phase 2 permits ±240 stacked units, 20 attached townhomes, and 4,500 SF commercial, with provisions to revert non-residential requirements if undeveloped within five years. The proposal includes three public benefits: dedication of 2 acres of open space to Mecklenburg County, construction to NGBS bronze standards, and a $10,000 contribution to County Parks & Recreation. Three deviations are requested: expanding the build-to zone from 35 to 50 feet, reducing build-to percentage from 60% to 30%, and allowing primary pedestrian entrances to face side streets or parking areas. Required streetscape and transportation improvements include turn lanes on David Taylor Drive, multi-use paths, sidewalks, bus stops, and new public roads.
