This petition rezones a 1.519-acre vacant outparcel at 1726 Alleghany Street from B-1(CD) ANDO (Neighborhood Business, conditional, Airport Noise Disclosure Overlay) to CG(CD) ANDO (General Commercial, conditional, Airport Noise Disclosure Overlay) to allow a 4,000-square-foot commercial use with an accessory drive-through. The conditional site plan limits maximum building height to 50 feet and sets setbacks of 36 feet front, 10 feet side, and 20 feet rear. The petitioner will provide an 8-foot planting strip and 8-foot sidewalk along Alleghany Street and Ashley Road, direct pedestrian connections, publicly accessible open space, and screening of drive-through lanes and solid waste areas. The plan requires dedication of 27 feet of right-of-way from the centerline of Alleghany Street and 54 feet from the centerline of Ashley Road, installation of accessible pedestrian signals to satisfy Tier 3 Multimodal assessment, and no new direct access to public streets. All transportation improvements and right-of-way dedications must be completed prior to the first certificate of occupancy. The rezoning is consistent with the 2040 Policy Map’s Commercial Place Type and supports standalone retail and restaurant development along high-volume arterial streets.
