The Atlanta City Council adopted Ordinance 24-O-1690, amending the 1982 Atlanta Zoning Ordinance to facilitate the preservation of mature trees. The ordinance modifies Section 16-26.003, "Conditions of granting a variance," to allow for variances to reduce required setbacks specifically for preserving mature trees (eight inches or more in caliper diameter). These variances require certification from the city arborist that the tree would be lost due to strict setback application or construction impact, with a condition for replacement if the tree dies. Additionally, a new Section 16-26.008, "Administrative zoning setback variances for the preservation of mature trees," was created, authorizing the Department of City Planning to approve administrative variances on single-family or two-family residential lots, reducing side yard setbacks by up to 50% for mature tree preservation. A similar new section, 16-20.003(f), was added for variances in Historic or Landmark Districts, to be granted by the Urban Design Commission. Notably, administrative variances are prohibited in historic or cultural conservation districts. The ordinance highlights the environmental and health benefits of urban trees.
