The Atlanta City Council adopted Ordinance 25-O-1098, amending the 1982 Atlanta Zoning Ordinance. This ordinance introduces new definitions for "Vape Shops" and "Elementary and Secondary Schools." It establishes a minimum distance requirement of 1,000 feet between vape shops and between vape shops and elementary/secondary schools, child care nurseries, day care centers, prekindergartens, kindergartens, play, and other special schools or day care facilities for young children. This regulation applies to businesses where alternative nicotine products, consumable vapor products, vapor devices, and consumable hemp products constitute at least 35% of their aggregate retail sales. The changes affect permitted uses in various commercial and industrial zoning districts, including C-1, C-2, C-3, C-4, C-5, I-1, I-2, and MRC zones. The ordinance was adopted on a substitute by a roll call vote of 11 yeas to 0 nays.
