This ordinance, sponsored by Councilmembers Antonio Lewis, Michael Julian Bond, Matt Westmoreland, Marci Collier Overstreet, and Eshé Collins, authorizes the Mayor of Atlanta to acquire property interests necessary for the Cleveland Avenue Safe Street Project. The ordinance allows for negotiations with property owners for the acquisition of these interests. It further authorizes title searches, appraisals, and surveys. In the event that negotiations are unsuccessful, the Mayor and the City Attorney are authorized to initiate condemnation proceedings using the Declaration of Taking Method, pursuant to O.C.G.A. § 32-3-1 et seq. Additionally, the ordinance waives certain provisions of Article X, Real Estate and Procurement Code, of the City of Atlanta Code of Ordinances. All contracted work and payments for property interests are to be charged to and paid from specified account numbers.
