The Atlanta City Council adopted an ordinance to waive the transitional height plane and transitional yard and screening requirements of the SPI-9 Zoning District for the property located at 505 Pharr Road, NE. This waiver also includes the variance requirement for a reduction in these same SPI-9 district requirements. The purpose of these waivers is to facilitate the development of a new high-rise mixed-use project on the site, which will incorporate a multi-family component and provide public parking for Bagley Park. The existing SPI-9 requirements were found to conflict with the ability to successfully integrate the needed additional parking for the adjacent park. The waivers are specifically conditioned on Avrohom Wolf, or an entity controlled by him, developing the property as a high-rise mixed-use building that includes public parking with access to Bagley Park, on terms mutually agreeable to the City and the developer. The property spans 1.896 acres, or approximately 82,600 square feet. The ordinance was adopted by a vote of 14 yeas to 0 nays.
