The ordinance amends Section 16-29.001 of the 1982 Atlanta Zoning Ordinance to replace “private gathering” with “commercial event” in the definition of “Party House” and clarifies the inclusion of ceremonies, receptions, and large-scale gatherings where fees are charged. It specifies that 501(c)(3) events remain exempt and establishes that party houses require a Special Administrative Permit or Special Use Permit and must be located at least 150 feet from properties zoned R-1, R-2, R-2A, R-2B, R-3, R-3A, R-4, R-4A, R-4B, R-5, RG, or MR, or used for residential purposes. The ordinance provides tables listing the zoning districts where party houses are permitted—including RL-C, C-1 through C-5, I-MIX, NC, MRC, MR, and specified SPI subareas—and those where they are prohibited, such as all R-1 through R-5, RG, O-I, I-1, I-2, PD-H, PD-MU, PD-OC, PD-BP, and specified SPI subareas. All conflicting ordinances or parts thereof are waived to the extent of the conflict.
