The City of Atlanta authorized the Mayor or designee to acquire temporary construction easements, permanent easements, rights-of-way, and other property interests needed to install 0.6 miles of sidewalks along Metropolitan Parkway GA-3/US-41 between Cleveland Avenue and Mount Zion Road. The ordinance waives certain procurement code requirements to expedite negotiations, authorizes environmental reports, appraisals, surveys, and due diligence, and allows property interests to be acquired at up to 20% above appraised values (or $1,000) without further Council approval. If negotiations fail, the City Attorney is empowered to initiate condemnation proceedings under O.C.G.A. ยง 32-3-1 et seq. The Mayor and City Attorney are authorized to execute all necessary documents, and the funding is charged to the 2022A1 GO Public Improvement (Social Bonds) Fund account for DOT capital project administration. The ordinance also waives city code provisions to streamline legal descriptions and option agreements, ensuring timely completion of the project.
