On May 5, 2025, the Atlanta City Council adopted an amended ordinance granting a Special Use Permit (SUP) for non-residential uses or establishments exceeding 7,500 square feet where alcoholic beverages are sold or consumed on the premises. The permit was granted to TGS Rooftop, Inc. for a property located at 1115 Howell Mill Road, NW, which fronts 350.67 feet on the east side of Howell Mill Road, NW and 416.49 feet on the south side of 14th Street, NW. The property has an area of 3.5665 acres. The special use permit is non-transferable and includes conditions related to outdoor music/amplified sound: no such sound after 10:00 PM Sunday-Thursday and after 11:00 PM on Friday-Saturday. The Staff Recommendation, NPU Recommendation, and ZRB Recommendation were all for approval, with conditions. The City Council adopted the ordinance as amended with a 12-0 vote.
