Atlanta Amends Zoning to Require Special Use Permits for Data Centers

The City of Atlanta has adopted Ordinance Z-25-10, amending its zoning ordinance to require Special Use Permits (SUP) for data centers citywide. This modification prohibits data centers in Neighborhood Commercial (NC) zoning districts and sets specific application requirements for proposed data centers to address their water consumption, water conservation, energy consumption, and other environmental impacts. Key requirements for SUP applications include detailed plans for water consumption, water conservation, energy consumption, transmission line impact assessments, tree preservation and reforestation, and stormwater management. Additionally, data centers not part of a unified plan are limited to 150,000 square feet per floor and must be at least 2,000 feet from another data center. Data centers part of a unified development plan are limited to 300,000 square feet per floor and also require a SUP. The ordinance also explicitly prohibits data centers within 2,640 feet of a high-capacity transit stop. The City Council voted to adopt the ordinance as amended with 14 yeas and 0 nays.
