The Louisville Metro Planning Commission is considering a text amendment to the Land Development Code (LDC) to define and regulate freestanding birthing facilities. This action is in response to Kentucky House Bill 90, which recently established state-level licensing standards for these centers. The proposed ordinance amends the LDC to add a definition for "Freestanding Birthing Facility" and includes it within the existing "Medical Clinic" land use category. A significant change proposed is to permit Medical Clinics by right within the C-3 Commercial District, which covers much of the downtown area, thereby removing the current requirement for a Conditional Use Permit in that zone. For all other zoning districts, a Conditional Use Permit will still be required. This amendment aims to reduce barriers for the establishment of birthing centers, increase access to maternal healthcare, and align the city's zoning regulations with state law and the goals of the Plan 2040 comprehensive plan.
